In the years 1777–1778 four volumes were published under the title Legal Observations on Several Dark and Until Now Unverified Sections of the Introduction. The volumes were composed by a society of young legal practitioners from The Hague, the most famous among them being Joannes van der Linden. By then Grotius’s Introduction to the Jurisprudence of Holland was still the cornerstone of the law of Holland and around the year 1800 it would become the fundament for attempts to codify this (...) law. Although Grotius never formulated a complete, comprehensive constitutional theory, traces of such a theory can be found in many of his writings not explicitly devoted to constitutional law. Punishment even plays an important role in his books on war, since to punish transgressions of the law is ranked among the just causes of war.Given the fact that a state may (...) punish transgressions of the law – transgressions by individuals within and even outside the state, but also transgressions of the law by other states – the question may arise concerning the origin of such a right to punish. It will be shown that Grotius did not give the same answer to this question in his various works. As the right to punish is concerned, we find a theory that seems to be akin to the one of John Locke in the De iure praedae, one akin to the theories of the Spanish late-scholastics in De satisfactione and De imperio, and a theory coming close to what Thomas Hobbes had said on the ruler's right to punish in the De iure belli ac pacis.Of course, Grotius can only have been familiar with the theory of the Spanish late-scholastics, since those of Locke and Hobbes were still to be written by the time Grotius had passed away. As a result of the political developments in the young and struggling Dutch Republic, Grotius experienced the lack of, and the need for juridical protection of some basic rights against infringements by the government. The privileges, taken for fundamental laws, did not provide this protection sufficiently. After he himself had been prosecuted, Grotius falls back on Holland's division of powers to secure the compliance of these rights.

Although relatively much has been said and written already on civilian based defence, one hardly can deny that there has been not much of an increase in our understanding of this particular alternative security concept. Hence, in the present article an attempt is made to trace the factors, which are to be held responsible for this rather striking case of theoretical stagnation. The main argument boils down to the assertion that, up till now, to much energy has been invested in (...) normative analysis and polemics. Together with the reality of a very restricted research capacity, this has led to an almost complete neglect of scientific research proper.Indeed, in the existing litterature it is hard to find any serious effort at theoretical articulation. One will search in vain for explicit stated modeis, testable hypotheses as welt as elaborated research strategies. Little wonder then, that hitherto scientific progress has been wanting. Accordingly, it is argued that to bring about any positive change in this respect in the future, a mere upgrading of the actual research capicity - as is so often advocated - wilt not suffice. Real progress is only to be expected, if more work is made of basic research. (shrink)

Zijn uitspraken zijn door de auteur gemoderniseerd en voorgesteld als tweets. Although the knowledge of war and international conflict has definitely increased, we do not as yet have much insight into why and how wars come about, and especially how war as a certain and comparably rare form of conflict regulation is connected to conflict behavior at lower levels of intensity as military disputes and international conflict behavior in general. Theoretical progress in the study of war demands a significant effort at the level of basic research. It is imperative to spend (...) more energy at the rigorous deduction of testable propositions from general explanatory principles or mechanisms. For the success of such an endeavour it is essential to adopt both a dynamic and systems-theoretic perspective. This implies a vision of war as a certain and one of possible phases in the international political process, concurrently with other injuriousforms of interaction as serious disputes and low level conflict behavior, but also supportive behavior like trade and cooperation. Yet, if we are to analyze and understand the war phenomenon from this perspective, clearly more formalized approaches and techniques are imperative. (shrink)

Ancient philosophers had always been fascinated by religion. From the first century BC onwards the traditionally hostile attitude of Greek and Roman philosophy was abandoned in favour of the view that religion was a source of philosophical knowledge. This book studies that change, not from the usual perspective of the history of religion, but as part of the wider tendency of Post-Hellenistic philosophy to open up to external, non-philosophical sources of knowledge and authority. It situates two key themes, ancient wisdom (...) and cosmic hierarchy, in the context of Post-Hellenistic philosophy and traces their reconfigurations in contemporary literature and in the polemic between Jews, Christians and pagans. Overall, Post-Hellenistic philosophy displayed a relatively high degree of unity in its ideas on religion, which should not be reduced to a preparation for Neoplatonism. (shrink)

The idea that the state ought to be neutral towards different conceptions of the good life has been an influential principle in liberal theory since the 1970s. It has, however, been subject to criticism by communitarians, multiculturalists and liberal perfectionists. Recently, Peter Balint has attempted to defend state neutrality against its liberal critics as the adequate interpretation of the liberal project by redefining it as a range concept. By arguing that neutrality always occurs within a specific range of permissible conceptions (...) of the good life, Balint provides a convincing rebuttal of neutrality’s critics. In this paper I argue that while neutrality as a range concept provides an adequate account of state neutrality, it also makes it vulnerable to a new line of critique. Since the range of neutrality cannot be deduced from the principle of neutrality itself, neutrality is subject to political developments beyond its own control. I will start by clarifying the notion of neutrality as a range concept. Secondly, I will demonstrate that Balint’s notion of the range concept finds ample support in the wider literature on neutrality. Thirdly, I will argue that, as a range concept, neutrality ultimately depends on politically constituted value judgments. (shrink)

Abstract‘Social inclusion’ is the leading ideal in services and care for people with intellectual disabilities in most countries in the Global North. ‘Social inclusion’ can refer simply to full equal rights, but more often it is taken to mean something like ‘community participation’. This narrow version of social inclusion has become so ingrained that it virtually goes unchallenged. The presumption appears to be that there is a clear moral consensus that this narrow understanding of social inclusion is good. However, that (...) moral consensus is not clear in the case of people with profound intellectual and/or multiple disabilities (PIMD), who are not able to express their needs and preferences verbally. Moreover, social inclusion has proven to be difficult to conceptualize and implement for people with PIMD. Therefore, it becomes imperative to ask about the ethical rationale of the narrow understanding of social inclusion. For what reasons do we think social inclusion is good? And do those reasons also apply for people with PIMD? This article addresses these questions by providing an ethical analysis of the ideal of social inclusion for people with PIMD. It discusses four ethical arguments for social inclusion and probes their relevance for people with PIMD. The article argues that none of these arguments fully convince of the value of the narrow understanding of social inclusion for people with PIMD. It ends with advocating for an ethical space for imagining a good life for people with PIMD otherwise. (shrink)

In 1730, the Dutch cartographer and meteorological observer Nicolaas Samuel Cruquius constructed a spectacular map of the river Merwede. Cruquius’s map is celebrated as one of the earliest to use lines of equal depth—or indeed any type of contour lines. So far, however, the secondary literature has paid no attention to why Cruquius created these lines or to the knowledge involved in his innovation. This essay makes three related points. First, Cruquius intentionally used lines representing equal depth in an entirely (...) new way: whereas earlier maps had used similar lines to represent a river’s navigability, for Cruquius they visualized river flow. Second, different technical and epistemic practices grounded the making of the map: Cruquius built on his expertise in surveying but also on practices from both natural history and mathematical physics, with which he was familiar through contacts at Leiden University and the Royal Society of London. Third, Cruquius’s case does not fit with the way work cutting across different fields of expertise is usually conceptualized. Cruquius did not just straddle different fields. Instead, he gave new meaning to lines of equal depth by integrating specific practices from different fields of expertise and omitting others; through this integration, Cruquius created a way to visualize water flows and gave shape to possible new ways of acting on the river and its environment. In this article, I examine the relation between Bateson and Guattari’s ecological thoughts: two thinkers whose ecological ideas at first sight have a lot in common. In order to show the difference between the thoughts of both thinkers, I will take my clue from Guattari’s remark that he parts ways with Bateson on the role of context. Explaining the role of context in both authors will allow me to show how Guattari’s thought implies both an endorsement and a critique of (...) cybernetics, and, specifically, promoting a machinic rather than cybernetic ecology. Information and computer technology has come to play an increasingly important role in medicine, to the extent that e-health has been described as a disruptive innovation or revolution in healthcare. The attention is very much focused on the technology itself, and advances that have been made in genetics and biology. This leads to the question: What is changing in medicine today concerning e-health? To what degree could these changes be characterized as a ‘revolution’? We will apply the work of Thomas (...) Kuhn, Larry Laudan, Michel Foucault and other philosophers—which offers an alternative understanding of progress and revolution in medicine to the classic discovery-oriented approach—to our analysis. Nowadays, the long-standing curative or reactive paradigm in medicine is facing a crisis due to an aging population, a significant increase in chronic diseases and the development of more expensive diagnostic tools and therapies. This promotes the evolution towards a new paradigm with an emphasis on preventive medicine. E-health constitutes an essential part of this new paradigm that seeks to solve the challenges presented by an aging population, skyrocketing costs and so forth. Our approach changes the focus from the technology itself toward the underlying paradigm shift in medicine. We will discuss the relevance of this approach by applying it to the surge in digital self-tracking through health apps and wearables: the recognition of the underlying paradigm shift leads to a more comprehensive understanding of self-tracking than a solely discovery-oriented or technology-focused view can provide. In this paper I address the current debate on ontic versus epistemic conceptualizations of mechanistic explanation in the mechanisms literature. Illari recently argued that good explanations are subject to both ontic and epistemic constraints: they must describe mechanisms in the world in such fashion that they provide understanding of their workings. Elaborating upon Illari’s ‘integration’ account, I argue that causal role function discovery of mechanisms and their components is an epistemic prerequisite for achieving these two aims. This analysis extends Illari’s (...) account in important ways, putting more pressure on ontic readings of mechanistic explanation and providing an answer to the question how ontic and epistemic constraints on mechanistic explanation are related. I argue these point in terms of cases on memory research drawn from neuroscience and research on extinct neurogenetic mechanisms from early nervous systems biology. (shrink)

The medical profession is observing a rising number of calls to action considering the threat that climate change poses to global human health. Theory-led bioethical analyses of the scope and weight of physicians’ normative duty towards climate protection and its conflict with individual patient care are currently scarce. This article offers an analysis of the normative issues at stake by using Korsgaard’s neo-Kantian moral account of practical identities. We begin by showing the case of physicians’ duty to climate protection, before (...) we succinctly introduce Korsgaard’s account. We subsequently show how the duty to climate protection can follow from physicians’ identity of being a healthcare professional. We structure conflicts between individual patient care and climate protection, and show how a transformation in physicians’ professional ethos is possible and what mechanisms could be used for doing so. An important limit of our analysis is that we mainly address the level of individual physicians and their practical identities, leaving out important measures to respond to climate change at the mesolevels and macrolevels of healthcare institutions and systems, respectively.
